Quick answer: AI and personal injury lawsuits are a risky combination and you should not use it for legal help. AI tools may help you organize notes, but they are not a reliable source of legal advice. They may cite laws or cases that do not exist and can misjudge what a claim may be worth. Using AI to handle your claim could also raise unauthorized practice of law concerns.

If you were hurt in Florida and are unsure what to do next, call the Law Offices of Jason Turchin at 800-337-7755 to talk with an experienced injury attorney about your options.

AI and Personal Injury Claims at a Glance

Question

Short answer

Can AI legally represent me?

No. AI cannot appear in court, sign pleadings or act as your attorney in Florida.

Is AI legal advice accurate?

Often not. AI may invent case law, use outdated statutes or overstate what a claim is worth.

Could using AI be the unauthorized practice of law?

It may be if a non-lawyer uses AI to handle a claim. If AI gives legal advice, that could violate the law.

Can AI negotiate with an insurance adjuster?

Not well. Adjusters may have handled hundreds of claims, and AI cannot read tone, leverage or timing.

How much does an injury lawyer cost in Florida?

Our firm handles cases on a contingency fee basis, with fees and costs waived if there is no recovery.

Why Is Using AI for an Injury Claim Risky?

Using AI for an injury claim is risky because chatbots are built to sound confident, not to be correct. They predict likely words, so they can produce answers that look polished but are often wrong about the law, the facts or the value of a case.

Courts around the country have already dealt with filings that cited court decisions that did not exist, and many of those citations were generated by AI tools. When a person relies on that kind of output in a real claim, the mistakes can follow them into letters to insurers, recorded statements and court papers.

Could Using AI Be the Unauthorized Practice of Law in Florida?

It could, depending on who is using the tool and for whom. Florida generally allows people to represent themselves, but a non-lawyer who uses AI to prepare demands, give advice or handle a claim for a friend or relative may cross into the unauthorized practice of law.

Under Florida Statute §454.23, practicing law in Florida without being licensed or otherwise authorized can be a third-degree felony. A family member who tries to help by running a loved one’s case through a chatbot may not realize the risk. Even when you handle your own claim, an AI tool providing legal advice could violate the law.

Does AI Get Florida Injury Law Wrong?

AI often gets Florida injury law wrong, especially where the law has recently changed. Many tools were trained on older material and may give advice that no longer applies.

Filing deadlines. Florida Statute §95.11 now gives two years for most negligence claims arising after March 24, 2023. A chatbot quoting the older four-year rule could cause someone to miss a deadline.

Comparative fault. Under Florida Statute §768.81, a person found more than 50 percent at fault generally may not recover damages in most negligence cases. AI may still describe Florida’s older pure comparative fault rule.

PIP treatment timing. Florida Statute §627.736 generally requires initial medical treatment within 14 days after a car crash for PIP benefits. Advice to “wait and see” could cost you coverage.

Why Can’t AI Tell You What Your Case Is Worth?

AI cannot reliably value an injury case because there are sometimes hundreds of factors that go into evaluating one. Many of them are not in any document you could paste into a chatbot.

An experienced accident attorney may weigh factors such as:

Available insurance policies, limits and stacking

Gaps in treatment and prior injuries

Future medical care and lost earning capacity

How the venue and local juries tend to view similar claims

Witness credibility and surveillance risk

Liens from health insurers, Medicare or Medicaid

The defense firm and insurer handling the claim

AI tends to swing both ways. It may overexaggerate value and lead someone to reject a fair offer, or it may lowball a claim and lead someone to accept far less than the case may be worth.

Can AI Negotiate With an Insurance Adjuster?

AI is a poor substitute for a skilled negotiator, because negotiation depends on judgment, timing and reading the other side. Adjusters may have handled hundreds of claims and are trained to limit payouts. Attorney Jason Turchin has handled more than 7,500 accident cases. An AI can’t understand those negotiation nuances and where to fight for higher settlements.

According to the Florida Department of Highway Safety and Motor Vehicles, over 238,000 people were injured in automobile accidents in Florida in 2025. Insurers see claims like yours every day. An adjuster may notice when a demand letter reads like AI output, cites the wrong law or claims damages that the records do not support, and that can weaken your credibility.

Examples of How AI Advice Can Hurt a Claim

The following are illustrations of common situations, not actual client cases.

The missed deadline. A Broward County driver asks a chatbot how long she has to sue after a rear-end crash and is told four years. By the time she calls a lawyer, the two-year deadline may have passed.

The fake citation. A man hurt in a store fall sends the insurer a demand citing a Florida case that sounds real but does not exist. The adjuster questions everything else in the letter.

The rushed settlement. A rideshare passenger asks AI if an early offer is fair. The tool says yes without knowing about a second policy or her need for future surgery.

AI Tools vs. an Experienced Injury Attorney

Task

AI chatbot

Experienced injury attorney

Citing Florida law

May invent or misquote laws

Checks current statutes and case law

Valuing a claim

Guesses from general data

Weighs case-specific factors and has actual experience

Negotiating

Cannot talk to an adjuster

Negotiates directly and can file suit

Confidentiality

No attorney-client privilege

Communications generally privileged

Accountability

None

Licensed and regulated by The Florida Bar

How Should You Handle a Personal Injury Claim in South Florida?

The safest approach is to protect your health and your evidence, then speak with a licensed Florida accident attorney before giving statements or signing anything.

Get medical care promptly and follow your doctor’s treatment plan.

Report the incident and request a copy of the police or incident report.

Take photos and save names and numbers of witnesses.

Avoid recorded statements to the other side’s insurer until you get advice.

Keep medical bills, receipts and proof of missed work.

Talk with an experienced attorney about your rights and deadlines.
