Bestway, Intex, and Polygroup Pools Recalled Due to Drowning Hazard

On July 21, 2025, the U.S. Consumer Product Safety Commission (CPSC) announced the recall of over 5 million above-ground pools manufactured by Bestway, Intex, and Polygroup. The recalled models are 48 inches or taller and contain external compression straps that can serve as footholds, allowing children to climb into the pool without a ladder and posing a serious drowning risk.

The pools, sold nationwide since 2002, have been connected to the deaths of at least nine children between the ages of 22 months and 3 years, along with several near-drowning incidents.

What’s the Hazard?

A Fatal Design Flaw: Climbable Compression Straps

The recalled pools use compression straps to help maintain structural integrity. However, these straps run on the outside of the pool, wrapping over the vertical support legs—unintentionally creating a climbable surface for young children.

Even when the ladder is removed, a child can step on the compression strap, pull themselves up using the support poles, and gain access to the water. Tragically, this design has allegedly led to fatal consequences in multiple states, including California, Texas, Florida, Michigan, Wisconsin, and Missouri.

Products Involved in the Recall

The recall includes above-ground pools measuring 48 inches or taller with external compression straps. The affected models were sold under various brand names at major retailers and online outlets.

Product Liability and Wrongful Death

These claims help hold manufacturers accountable for unsafe products and may provide financial relief for the harm caused.

What is the hazard?

The external compression strap creates a climbable step for children, allowing them to enter the pool even if the ladder is removed.

What injuries or deaths have occurred?

The CPSC is aware of nine drowning deaths of children ages 22 months to 3 years, plus three other near-drowning incidents.

Is the recall only for certain brands?

Yes. The recall includes Bestway, Intex, and Polygroup pools 48 inches or taller with external compression straps.

How do I know if my pool is affected?

Look for the brand and model printed on the pool liner. If your pool is 48 inches or taller and has a compression strap running on the outside of the vertical supports, it is likely included.

Can I still use my pool?

Not until the repair kit is installed and the compression strap is removed. Until then, secure the area or drain the pool to prevent access.

Polygroup Pool Recall Linked to Child Drowning Deaths

In July 2025, the U.S. Consumer Product Safety Commission (CPSC) announced a major recall of approximately 5 million above-ground pools manufactured by Polygroup and two other companies. These 48-inch and taller pools pose a serious drowning hazard due to a design flaw involving external compression straps that run on the outside of the pool over the vertical support legs.

These straps, intended to provide structural support, unintentionally created footholds that children could use to climb into the pool—even without a ladder. Tragically, the CPSC has linked nine child drownings between 2007 and 2022 to this very hazard.

If your child or loved one drowned in a Polygroup pool later included in this recall, you may be entitled to seek justice through a wrongful death lawsuit.

Which Polygroup Pools Were Recalled?

The recall applies to multiple Polygroup pool models sold between 2006 and 2025, including:

Summer Escapes (2006–2015)

Summer Waves (2015–2025)

Funsicle (2023–2025)

Sand N Sun (2008–2011)

Blue Wave (2014–2025)

These pools were sold at major retailers nationwide—including Walmart, Target, Costco, The Home Depot, and online platforms such as Amazon and Wayfair.

If your pool featured a compression strap that ran outside and over the vertical support legs, it may be part of the recall—even if the drowning occurred years before the recall notice was issued.

What Is a Wrongful Death Lawsuit?

A wrongful death lawsuit is a civil legal action brought by surviving family members when a person dies due to someone else’s negligence. In this case, you may be able to hold Polygroup accountable for:

Manufacturing or distributing a dangerously designed product

Failing to properly warn consumers of potential risks

Not recalling the product in a timely manner

What Compensation Can Be Recovered?

If your lawsuit is successful, you may be eligible for compensation covering:

Frequently Asked Questions

What if the drowning happened before the recall?

You can still file a wrongful death lawsuit even if the drowning occurred before the product was officially recalled. The key factor is whether the pool had a dangerous design flaw—not when the company acknowledged it.

Do I need a purchase receipt to file a claim?

Not necessarily. Photos of the pool, documentation of ownership, or witness testimony may be enough to prove the model involved.

How long do I have to file a claim?

Wrongful death statutes of limitations vary by state, but many allow between one to three years from the date of death. Acting quickly ensures the preservation of evidence and your legal rights.

Intex Pools Under Recall Following Drowning Hazard

In July 2025, the U.S. Consumer Product Safety Commission (CPSC) and Intex Recreation Corp. announced a recall of certain 48-inch and taller above-ground pools manufactured with external compression straps. These straps, which run around the outside of the pool and over the vertical support legs, have been found to create dangerous footholds that allow children to climb into the pool—even without a ladder present.

The recall follows reports that at least nine young children drowned after gaining access to the pool via these footholds. If your loved one was one of them, you may have legal options.

Understanding Wrongful Death in the Context of a Product Recall

A wrongful death lawsuit is a civil claim that arises when a person dies due to the negligence, recklessness, or misconduct of another party. In the case of the Intex pool recall, the responsible party may include:

Intex Recreation Corp., as the product manufacturer

Retailers or distributors that sold the recalled pool

Other parties who may have contributed to the unsafe conditions

Criteria for Filing a Wrongful Death Lawsuit After an Intex Pool Drowning

To successfully file a claim, you must typically prove the following:

The pool was defective or unreasonably dangerous, particularly due to the external compression straps.

The defect directly led to the drowning, such as a child climbing into the pool using the straps.

The victim died as a result of the incident.

The claimant has legal standing, such as being a parent, spouse, child, or personal representative of the deceased’s estate.

Our legal team can help investigate the details and gather the necessary evidence to support your claim.

If you lost someone in an Intex pool accident, here’s what you should do immediately:

1. Secure the Pool and Preserve Evidence

Do not discard the pool or accessories.

Take clear photos showing the external compression strap configuration.

Document the pool’s condition, brand markings, and any warning labels.

2. Request Medical and Autopsy Records

These can help establish the official cause of death and timeline.

3. Consult an Experienced Product Liability Attorney

An attorney can verify whether the pool involved matches the recalled models and help you determine liability.

Details of the Intex Pool Recall

The recalled Intex pools were sold between 2002 and 2012, and again in 2024–2025 exclusively on Intexcorp.com and Walmart.com.

Key facts about the recall:

The external compression straps created an unintended climbing aid.

Nine children between 22 months and 3 years old are believed to have drowned due to this hazard.

Intex is providing free repair kits to current pool owners.

Consumers are urged to cut and remove the compression strap only after installing the new safety rope included in the repair kit.

If your drowning incident occurred before the recall was announced—or even before the kits were available—this could further strengthen your legal claim.

What Damages Can Be Recovered in a Wrongful Death Lawsuit?

You may be entitled to recover:

Medical expenses related to the incident

Loss of financial support

Loss of companionship, care, and guidance

Pain and suffering

Punitive damages (if gross negligence is proven)

Every case is unique. We can help assess your full legal and financial rights.

Yes. Companies can still be held liable if the product’s defect existed before the recall was issued.

What if I no longer have the receipt?

That’s okay. Photos of the pool, or even witness statements, may be enough to identify the product. We can assist with documentation and model verification.

Is there a deadline to file?

Yes. Each state has a statute of limitations for wrongful death cases—often 1 to 3 years from the date of death. Acting quickly is often crucial.

Entrusting your child to a daycare facility is often one of the most significant decisions a parent can make. Parents expect these institutions to provide a safe, nurturing, and well-supervised environment where their children can learn and play. Unfortunately, accidents and injuries can occur, sometimes due to negligence or unsafe practices. If your child has been injured at a daycare in Florida, understanding your legal options can be essential to protecting their rights and securing the compensation they deserve.

Common Causes of Daycare Injuries

Daycare injuries can happen for a variety of reasons, many of which stem from negligence, improper supervision, or unsafe conditions. Common causes include:

Lack of Supervision: When children are left unsupervised, they may engage in risky behaviors or inadvertently hurt themselves or others.

Unsafe Play Areas: Broken equipment, exposed hazards, or poorly maintained playgrounds pose significant risks to children.

Staff Negligence: Caregivers who are inattentive, overworked, or improperly trained may fail to prevent or respond to accidents.

Food Safety Issues: Serving contaminated food, failing to address dietary restrictions, or exposing children to allergens can cause serious illnesses or allergic reactions.

Physical Abuse: In rare but tragic cases, children may suffer harm from abusive staff members or aggressive behavior from other children.

These situations highlight the importance of proper training, supervision, and adherence to safety protocols in daycare facilities.

Common Injuries at Daycare Facilities

The injuries children sustain at daycare facilities can range from minor to severe. Some of the most common include:

Cuts, Bruises, and Scrapes: These minor injuries often occur during play but can result from unsafe equipment or surfaces.

Broken Bones or Sprains: Falls from playground equipment or tripping over hazards can lead to fractures or sprains.

Head Injuries: Concussions or more severe traumatic brain injuries (TBIs) may occur from falls or being struck by objects.

Burns: Hot surfaces, spilled liquids, or kitchen accidents can cause burns.

Allergic Reactions or Food Poisoning: Inadequate attention to dietary needs or unsanitary food practices can result in medical emergencies.

The severity of these injuries can have lasting physical and emotional effects on children and their families.

Steps to Take if Your Child Is Injured at Daycare

If your child is injured while at a daycare facility, taking immediate action can protect their health and strengthen your potential legal claim. Follow these steps:

Seek Medical Attention: Prioritize your child’s well-being by getting a thorough medical evaluation. Even minor injuries should be examined by a healthcare professional to rule out hidden complications.

Document the Incident: Take photos of your child’s injuries, the scene of the accident, and any hazards that may have contributed to the injury.

Request an Incident Report: Ask the daycare staff or management to document the incident. Ensure you receive a copy of the report for your records.

Gather Evidence: Collect relevant evidence, such as medical records, witness statements, and any surveillance footage from the daycare facility.

Report the Incident: Notify the appropriate regulatory authorities, such as Florida’s Department of Children and Families (DCF), especially if you suspect negligence, abuse, or violations of daycare regulations.

Consult a Personal Injury Lawyer: Seek legal advice from an experienced attorney who can guide you through the claims process and help protect your child’s rights.

Liability in Daycare Injury Cases

Determining liability in daycare injury cases can be complex and often involves multiple parties. Potentially responsible parties include:

Daycare Facility Owners: Facility owners have a legal obligation to maintain safe premises and hire qualified, well-trained staff.

Individual Staff Members: Caregivers who act negligently or recklessly may be held personally accountable for injuries.

Third-Party Vendors: If defective equipment or unsafe products contributed to the injury, manufacturers or suppliers may be held liable.

An experienced attorney can thoroughly investigate the circumstances of your child’s injury, identify all responsible parties, and build a strong case for compensation.

How a Florida Personal Injury Lawyer Can Help

Navigating a daycare injury claim can be overwhelming, especially when dealing with insurance companies or uncooperative daycare providers. A Florida personal injury lawyer can:

Investigate the Incident: Gather crucial evidence, interview witnesses, and consult with experts to strengthen your case.

Negotiate with Insurers: Handle all communication with insurance companies to ensure you receive fair compensation.

File Necessary Paperwork: Ensure that all legal documents are filed correctly and within Florida’s statute of limitations.

Represent You in Court: If a fair settlement cannot be reached, your attorney can advocate for your child’s rights in court.

Compensation Available in Daycare Injury Claims

A successful daycare injury claim may provide compensation for:

Medical Expenses: Coverage for current and future medical bills, including rehabilitation and therapy.

Pain and Suffering: Compensation for the physical pain and emotional distress experienced by your child.

Emotional Distress: Damages for the trauma and anxiety caused by the incident.

Lost Wages: Reimbursement for parents who had to take time off work to care for their child.

Out-of-Pocket Expenses: Compensation for additional costs related to the injury, such as transportation or specialized childcare.

Overview of the Onasti Toddler Tower Stool Recall

On March 13, 2025, Blissful-Time announced a recall of approximately 10,300 Onasti Toddler Tower Stools due to a serious fall and injury hazard. The stools may collapse or tip over while in use, creating a significant risk to young children. The recall follows reports of four incidents, including two injuries, one of which resulted in a brain injury to a toddler.

Consumers who own these stools should immediately stop using them and store them away from children until they receive a free repair kit from Blissful-Time.

The recalled Onasti Toddler Tower Stools are plastic, foldable, triangular-shaped stools designed to help toddlers safely reach elevated surfaces. However, due to structural weaknesses, the stools may collapse or tip over, leading to severe injuries.

Blissful-Time has received reports of these stools collapsing, including:

One incident resulting in bruising.

BCI Burke Playground Merry-Go-Round Recall Overview

BCI Burke has issued a recall for its Playground Merry-Go-Rounds due to a significant crush hazard. The recall follows reports that the space between the rotating platform and the stationary outer rim can leave a gap that narrows too much, posing a crushing hazard to children.. This recall affects thousands of playgrounds across the United States where the equipment has been installed.

Recalled Product Details:

Product Name: BCI Burke Playground Merry-Go-Rounds

Hazard: Risk of center post detachment, posing crush and entrapment hazards

Units Recalled: Approximately 500 units installed at playgrounds nationwide

Reported Incidents: Reports of finger crushing injuries.

Consumers and facilities are urged to stop using the recalled merry-go-rounds immediately and contact BCI Burke for a free repair or replacement. Continuing to use the defective equipment could result in severe injuries.

Understanding Product Liability in Playground Equipment Injury Cases

Manufacturers of playground equipment have a duty to ensure their products are safe for children and other users. When defective equipment causes harm, product liability law allows victims and their families to pursue compensation. In the case of the BCI Burke Playground Merry-Go-Round recall, injured individuals may be eligible to file a claim.

The three main types of product liability claims include:

Design Defect: This arises when the product’s design is inherently dangerous. If the design of the merry-go-round makes it prone to cause injury during normal use, this would constitute a design defect.

Manufacturing Defect: A manufacturing defect occurs when the product is properly designed but becomes dangerous due to errors during production. If faulty materials or assembly caused the merry-go-round to fail, this would be classified as a manufacturing defect.

Failure to Warn: Manufacturers must provide clear instructions and warnings about potential risks associated with their products. If BCI Burke failed to warn playground operators or users about the risk of crush injuries, they may be liable under failure to warn.

Compensation for Injuries from Defective Playground Equipment

If you or a loved one were injured by a defective BCI Burke Playground Merry-Go-Round or any playground equipment, you may be entitled to compensation for:

Medical Expenses: Injuries from playground equipment malfunctions can range from bruises to severe fractures, head injuries, and internal trauma. Compensation can cover emergency care, surgeries, rehabilitation, and ongoing medical expenses.

Lost Wages: If a parent or guardian needed to miss work to care for an injured child, or if an adult was injured themselves, lost wages may be recoverable.

Pain and Suffering: Injuries sustained on playground equipment can cause significant physical pain and emotional trauma, especially for children. Compensation for pain and suffering accounts for the physical and emotional impact of the incident.

Disfigurement and Scarring: Severe injuries may result in long-term disfigurement or visible scarring, requiring additional treatment or impacting the victim’s quality of life.

Punitive Damages: In cases where the manufacturer’s negligence was particularly egregious, punitive damages may be awarded. These damages serve to punish the company and deter similar conduct in the future.

Steps to Take If You’ve Been Injured by Defective Playground Equipment

If you or your child were injured while using a recalled BCI Burke Playground Merry-Go-Round, taking the following steps can help protect your legal rights:

Seek Medical Attention: Injuries from playground equipment should be evaluated by a medical professional immediately, even if they seem minor. Keep records of all treatments and associated costs.

Document the Incident: Take photos of the defective merry-go-round, any visible injuries, and any surrounding damage caused by the incident. Record the date, time, and details of the injury.

Preserve Evidence: If possible, ensure that the playground equipment is not repaired or removed until it has been inspected. This evidence can be critical for your case.

Report the Issue: Notify the playground owner, operator, or facility where the equipment is located, as well as BCI Burke. Follow any recall instructions provided by the manufacturer.

Consult an Experienced Product Liability Attorney: An attorney with experience in defective product cases can guide you through the legal process, investigate the equipment failure, and help you seek compensation for your injuries.

Determining Liability in a Child Injury Claim

Negligence: Was there a failure by the school staff to act reasonably under the circumstances? This could include failing to supervise children properly or not maintaining school equipment.

Foreseeability: Was the accident something that the school could have anticipated and prevented?

Duty of Care: Schools have a duty to protect students from harm. This involves providing adequate supervision, maintaining a safe environment, and intervening in harmful situations like bullying.

Document the Incident: Record details of the incident while they are fresh. This includes taking pictures of the injury and where it happened, and writing down accounts of what occurred.

Report the Injury: Notify the school administration formally. This report should be in writing and detail how the injury occurred and any measures taken immediately afterward.

Contact a Lawyer: Particularly for serious injuries, speak to a lawyer who is experienced in personal injury or specifically in school injuries. They can advise on the legal options and the possibility of claiming compensation.

Filing a Claim: Submitting a claim against the school district or other responsible parties.
