New York Midea Mold Claim Lawyer – Compensation for Mold Exposure From Recalled U and U+ Air Conditioners

If you live in New York and developed respiratory problems, allergic reactions, or other health issues after using a Midea U or U+ window air conditioner, you may be eligible to file a mold exposure lawsuit. On June 5, 2025, the U.S. Consumer Product Safety Commission (CPSC) announced a major recall of more than 1.7 million Midea-brand air conditioners due to a defect that may lead to mold growth inside the unit.

The Law Offices of Jason Turchin is actively reviewing Midea mold claims for residents throughout New York, and can help victims throughout NY including New York City, Long Island, Buffalo, Rochester, Syracuse, and surrounding areas. If you or a loved one suffered health issues related to mold exposure from one of these recalled units, contact us at 800-337-7755 or use our live chat to schedule a free consultation.

About the Midea Mold Recall

Midea’s recall affects U and U+ series window air conditioners sold between March 2020 and May 2025. These units can retain water due to poor internal drainage. The stagnant water promotes mold growth, which may then circulate mold spores into your home or apartment through the air, potentially leading to serious health issues.

The recall impacts air conditioners sold under numerous brand names, including Midea, Frigidaire, Danby, Insignia, Comfort Aire, Mr. Cool, and others. The units were available in 8,000, 10,000, and 12,000 BTU versions.

Where Were the Units Sold in New York?

New York consumers may have purchased these units at major national and regional retailers, including:

  • Best Buy
  • Home Depot
  • Costco
  • Amazon
  • Walmart
  • Lowe’s
  • BJs Wholesale Club
  • Menards (online orders)

If you purchased or used one of these units in your New York home, apartment, dormitory, or office, and suffered from mold-related health issues, you may be eligible for a Midea mold lawsuit.

What Health Risks Are Linked to Mold Exposure?

Mold exposure is a recognized health hazard, particularly when it affects the air you breathe daily. According to the Centers for Disease Control and Prevention (CDC), exposure to mold may cause:

  • Respiratory infections
  • Allergic reactions
  • Asthma attacks
  • Persistent coughing or wheezing
  • Sneezing and sinus congestion
  • Itchy eyes and skin irritation
  • Sore throats or hoarseness

People with pre-existing health conditions, such as asthma, COPD, immune deficiencies, or severe allergies, are at greater risk of complications from mold exposure.

Midea reported 152 complaints of mold growth, and at least 17 individuals reported illnesses—including coughing, sore throats, and respiratory infections. These numbers may underrepresent the true scope of injuries caused by the defect.

Do You Qualify for a Midea Mold Claim in New York?

You may qualify if you:

  • Purchased or used one of the recalled air conditioners in your New York home, apartment, or workplace
  • Developed health symptoms consistent with mold exposure
  • Were treated by a medical provider for respiratory or allergic conditions
  • Missed work, lost income, or faced ongoing health problems due to the exposure

New York law allows victims of defective or dangerous consumer products to pursue compensation through a product liability lawsuit. If your injuries were caused by mold exposure from a recalled Midea AC unit, you may be entitled to damages for:

  • Medical expenses (past and future)
  • Lost wages from missed work or reduced capacity
  • Pain and suffering
  • Emotional distress
  • Cost of replacing the defective unit
  • Home mold remediation costs

Midea’s Refund and Repair Program May Not Be Enough

Midea is offering affected consumers either a repair or a partial refund. Some consumers may be eligible for:

  • A free shipping label to return the unit
  • A repair kit with a drain plug and instructions
  • A full or prorated refund (depending on purchase date)

However, this refund does not account for your medical costs, lost income, or long-term health problems. If you were physically harmed, you may be entitled to much more than a partial refund.

Frequently Asked Questions – Midea Mold Claim in New York

Can I sue Midea for mold exposure in New York?

Yes. If you suffered health issues related to a defective Midea AC unit in New York, you may be able to file a product liability lawsuit seeking compensation for your injuries.

What compensation can I receive?

You may be entitled to compensation for medical bills, lost wages, pain and suffering, and home remediation costs due to mold damage.

What if I accepted Midea’s refund or repair?

You may still have a valid injury claim. Accepting a refund for a defective product does not waive your right to pursue a lawsuit for physical harm caused by the product.

How long do I have to file a Midea mold lawsuit in NY?

New York’s statute of limitations for personal injury claims is generally 3 years from the date of injury or discovery. You should speak with a lawyer as soon as possible to protect your rights.

Do I need a receipt or warranty?

A receipt can help, but it’s not required. We may be able to establish your use of the unit through photos, testimony, serial numbers, or purchase history from retailers.

Can tenants in New York file a mold claim?

Yes. If you used a recalled AC unit in your rental and suffered health problems, you may still be entitled to compensation—even if your landlord bought the unit.

No. We work on a contingency fee basis, meaning you don’t pay fees or costs unless we win or settle your case.
