Florida Auto Accident Claims at a Glance

QuestionShort answer
Who may be able to file a claim?Drivers, passengers, motorcyclists, cyclists and pedestrians hurt because of another driver’s negligence or a vehicle defect may be able to file a claim.
Does my own insurance pay first?Usually, yes. Under Florida’s no-fault system, your own PIP coverage generally pays first for covered medical bills and lost wages, up to its limits.
How long do I have to file a lawsuit? For most negligence claims arising on or after March 24, 2023, Florida generally allows two years. Other deadlines can apply, so acting early matters.
What if I was partly at fault?Florida uses modified comparative negligence. You may still recover reduced damages if you are found 50 percent or less at fault.
What does it cost to hire the firm?Cases are handled on a contingency fee basis, with fees and costs waived if there is no recovery.

Why Do So Many Motor Vehicle Accidents Happen in Florida?

Most Florida crashes are caused by careless driving, speeding, failure to yield to other drivers, vehicle defects, old or faulty vehicle equipment and recklessness. Heavy tourist traffic, busy interstates and year-round motorcycle and bicycle riding add to the risk.

The numbers show how common these crashes are. Between 1/1/2026 and 10/22/2026, there were approximately 284,831 crashes in Florida, according to the Florida Department of Highway Safety and Motor Vehicles crash dashboard. According to the Florida Department of Highway Safety and Motor Vehicles, over 238,000 people were injured in automobile accidents in Florida in 2025, and an estimated 2,995 people died in crashes in Florida in 2025.

Aggressive driving also plays a part. Drivers who tailgate, cut off other cars or act out in anger can cause serious collisions, and victims of road rage accidents may have legal options against the driver responsible.

When the Law Offices of Jason Turchin investigates a crash, the focus is not only on the person responsible for the crash, but also on other factors that may have increased the damage or led to the crash. That can include defective parts, poor maintenance and an employer’s role.

What Types of Motor Vehicle Accidents Can Lead to a Claim?

Nearly any crash on a Florida road can lead to an injury claim when someone else’s negligence caused it. Each type of crash raises its own questions about fault and insurance.

  • Car accidents. Automobile accidents make up the majority of motor vehicle related injury cases the firm often sees in Florida, including rear-end, lane change, speeding, red light and stop sign crashes. Because of safety features, you may not feel the extent of your injuries for days, so it is important to seek medical attention right away.
  • Motorcycle accidents. Motorcycle accidents can be catastrophic and often deadly, leading to traumatic brain injury, paralysis, spinal cord injury, road rash and even accidental death. Over 590 people died in motorcycle accidents in Florida in 2025, according to the FLHSMV crash dashboard. Learn more about Florida motorcycle accident claims.
  • Scooter accidents. Like motorcycles, the small size of a scooter can mean a careless driver fails to notice it, leading to severe injuries and death.
  • Pedestrian accidents. Pedestrians typically have the right of way, but careless or reckless motorists often fail to yield in the crosswalk. Without the protection of a car and a seatbelt, these crashes can be very serious.
  • Truck and 18-wheeler accidents. Large trucks have many blind spots, and drivers who work more hours than allowed may drive while fatigued. See how the firm handles Florida 18-wheeler accident claims.
  • Bicycle accidents. Motorists are expected to share the road with and yield to bicycle riders. In 2025, there were nearly 10,000 bicycle crashes in Florida, according to the FLHSMV crash dashboard.
  • Bus accidents. Buses have blind spots like trucks, and poorly maintained buses can have parts that malfunction, injuring passengers and other drivers.
  • Taxi and rideshare accidents. Some cab drivers don’t require passengers to wear seatbelts, and some cabs don’t provide them, which can lead to more serious injuries. Read more about taxi accident claims in Miami and Fort Lauderdale.
  • Hit-and-run accidents. In 2025, there were over 92,000 hit and run crashes in Florida, according to the FLHSMV crash dashboard. Victims may still have options through their own coverage, as explained on our page about a hit-and-run accident in Miami.

How Does Florida No-Fault Insurance Work After a Crash?

Florida is a no-fault state, so your own personal injury protection (PIP) coverage usually pays first for covered medical bills and lost wages, regardless of who caused the crash. Florida Statute §627.736 sets the required PIP benefits, which are generally limited to $10,000.

To use PIP medical benefits, you generally must get initial medical treatment within 14 days of the crash. This is one reason to see a doctor promptly, even if you feel fine at first.

PIP rarely covers everything after a serious crash. Under Florida Statute §627.737, an injured person may be able to step outside the no-fault system and seek damages for pain and suffering from the at-fault driver when the injury meets a legal threshold, such as a permanent injury or significant scarring.

CoverageWhat it generally pays forWhose policy it is
Personal injury protection (PIP)A share of medical bills and lost wages up to policy limits, no matter who caused the crashYour own policy
Bodily injury liabilityInjuries the at-fault driver caused to others, including pain and suffering when the threshold is metThe at-fault driver’s policy
Uninsured/underinsured motorist (UM)Your losses when the at-fault driver has no insurance or not enoughYour own policy

What Is Underinsured Motor Vehicle Coverage?

Underinsured motor vehicle coverage pays for your injuries when the at-fault driver has some insurance but not enough to cover your losses. It is part of uninsured/underinsured motorist (UM) coverage on your own auto policy.

Florida does not require most drivers to carry bodily injury liability coverage, so many at-fault drivers have little or none. Under Florida Statute §627.727, insurers must offer UM coverage, though a policyholder can reject it in writing. If you have it, it may be a key source of recovery after a serious crash or hit-and-run.

Who Is Liable in a Multi-Vehicle Rear-End Crash?

In a multi-vehicle rear-end crash, liability may be shared among several drivers, depending on who was following too closely, speeding or distracted. The rear driver is often presumed at fault in Florida, but that presumption can be challenged with evidence.

Chain-reaction crashes on I-4 near Kissimmee, on I-95 in Miami or on any busy Florida road often involve several insurers pointing at each other. Police reports, photos, vehicle damage, witness statements and dash camera video can help show which impacts caused which injuries. For more detail, read who is at fault in Florida if you are rear-ended.

Florida uses modified comparative negligence under Florida Statute §768.81. In most negligence cases, a person found more than 50 percent at fault for their own harm cannot recover damages, and a person found less at fault may have their recovery reduced by their share of fault.

Can Strict Liability Apply When a Vehicle Defect Caused the Crash?

Yes, in many cases. When a defective part, such as faulty brakes, tires, seats or airbags, caused a crash or made injuries worse, the injured person may be able to bring a product liability claim against the manufacturer under strict liability, without proving the company was careless.

Airbags are designed to protect and cushion drivers and passengers. However, a major recall on Takata airbags revealed that cars equipped with those airbags were firing metal shrapnel or deploying with excessive force, leaving drivers and passengers with serious and sometimes permanent injuries. Read about the urgent safety warning on faulty airbags.

Defect claims depend on preserving the vehicle and its parts. If you suspect a defect, avoid letting the vehicle be repaired, salvaged or destroyed before it can be inspected.

What If a Commercial Truck or Rental Vehicle Was Involved?

A Florida truck accident lawyer can help after a commercial crash by identifying every party that may be responsible, such as the driver, the trucking company, a maintenance company or a cargo loader, and by working to preserve driving logs, inspection records and electronic data before it is lost.

Commercial carriers must follow federal safety rules, including limits on driver hours. Violations of those rules may help show negligence. Delivery van and truck crashes involving large companies can raise similar questions about who employed the driver and whose insurance applies.

Rental vehicle crashes in places such as Lakeland, Sunrise or Orlando can involve the renter’s own policy, coverage bought at the counter and the rental company’s policy. Federal law often limits claims against rental companies themselves, so a claim usually focuses on the negligent driver and every available insurance policy.

What Should You Do After a Car Accident in Florida?

After a crash, your first priorities are safety, medical care and preserving evidence. These steps may help protect both your health and your claim.

  1. Call 911 and get medical help for anyone who is hurt.
  2. Ask for a police report and note the report number.
  3. Photograph the vehicles, the scene, road conditions and your injuries.
  4. Get names, phone numbers and insurance details from other drivers and witnesses.
  5. See a doctor within 14 days, even if you feel fine, so PIP benefits may be available.
  6. Notify your own insurer, but avoid recorded statements to the other driver’s insurer before getting legal advice.
  7. Keep medical records, bills, pay stubs and repair estimates in one place.
  8. Talk with an experienced Florida auto accident lawyer before signing any release or accepting a settlement.

How Do You Choose an Experienced Florida Personal Injury Attorney After a Car Crash?

Look for an attorney with experience in motor vehicle cases, clear fee terms and a track record of peer and client recognition. You should feel comfortable asking questions and getting straight answers.

  • Relevant experience. Ask how often the firm handles car, truck and motorcycle cases.
  • Fee structure. Confirm whether the firm works on contingency and what happens if there is no recovery.
  • Independent ratings. Check peer reviews, client reviews and bar standing.
  • Communication. Ask who will handle your case and how you will get updates.
  • Resources. Ask how the firm investigates crashes, including defects and commercial carriers.
