Florida Bicycle Accident Lawyers
Florida’s year-round sunshine makes it a haven for bicyclists, but it is also one of the most dangerous states in the country for riders. In 2025 alone, Florida reported a staggering 9,914 bicycle crashes, resulting in 201 tragic fatalities. Bicyclists are considered “vulnerable road users” under Florida law, meaning they face a much higher risk of severe injury in a crash because they are not protected by a vehicle frame. The Florida Bicycle Accident Lawyers from the Law Offices of Jason Turchin have handle many bike accident claims for victims hurt in accidents while riding a bike.
If you were injured or lost a loved one in a bicycle crash, the Law Offices of Jason Turchin is here to help. We can represent victims across the entire state of Florida. Call us 24/7 at (800) 337-7755 for a free consultation. We handle all bicycle injury claims on a contingency fee basis, meaning you pay no out-of-pocket fees or costs unless we recover money for you.
How Our Bicycle Accident Lawyers Can Help
Through our complex method of investigation, we can look deeply into the crash to uncover all possible sources of compensation. We can research the insurance information of the at-fault driver, the vehicle owner, and their financial worth if their insurance is inadequate. We can also look into the background of the defendant to see if they have a history of traffic offenses or reckless driving.
Our law firm has successfully settled cases with nearly every automobile insurance company operating in Florida, including GEICO, Progressive, State Farm, Allstate, USAA, and Liberty Mutual. We estimate that over 95 percent of all cases our office handles are settled without the stress and expense of a lawsuit. However, if the insurance company refuses to offer a fair settlement, our litigation attorneys are fully prepared to take your case to trial.
Critical New Florida Laws Impacting Your Bicycle Claim
In March 2023, Florida enacted House Bill 837, which drastically changed the legal landscape for personal injury victims. If you were injured recently, you must be aware of these new legal hurdles:
The Strict 2-Year Statute of Limitations
For decades, injured bicyclists in Florida had four years to file a negligence lawsuit. However, this new law reduced the statute of limitations from four years to two years for cases based on negligence. This means if your accident occurred after March 24, 2023, you now generally have only two years from the date of the crash to file your lawsuit. If you fail to file within this strict timeframe, you may permanently lose your right to recover compensation.

The 51% Rule (Modified Comparative Negligence)
Insurance companies love to blame bicyclists for crashes, often claiming the rider wasn’t wearing reflective gear or drifted out of the bike lane. Before HB 837, Florida was a “pure comparative negligence” state, allowing injured victims to recover some compensation even if they were mostly at fault.
Now, Florida follows a “modified comparative fault” system. Under this new system, if you are found to be more than 50 percent at fault for the accident, you may be legally barred from recovering any financial compensation from the opposing side. This makes hiring an accident attorney to defend your actions and prove the driver’s negligence often critical.
Your PIP Coverage Still Applies
Florida is a no-fault state, meaning every driver is required to carry Personal Injury Protection (PIP) insurance. This coverage can be used if you are in an accident, even if you were riding your bicycle and not inside your vehicle when the crash occurred.
Compensation for Bicycle Accident Injuries
Because of the lack of physical protection, bicycle crashes frequently result in severe orthopedic trauma, traumatic brain injuries (TBI), and spinal cord damage. Our office can fight aggressively to recover:
- Past and future medical expenses, including surgeries and rehabilitation.
- Lost wages and diminished future earning capacity.
- Pain, suffering, emotional damages, and mental anguish.
- In tragic wrongful death cases, we can fight to recover funeral expenses, loss of companionship, and loss of support for surviving family members.
