What is claimed in an instant pot lawsuit?

Numerous reports have been made of instant pots exploding in kitchens across the United States. When hot liquid spews out from the pressure cooker, it can cause serious burn injuries to anyone in the explosion zone. The debris field can scald someone's face, arms, breast, leg and more. It can cause someone to lose their vision, require skin grafting surgery, and cause permanent scarring. A lawsuit against instant pot may allege:
  • That Instant Brands designed, manufactured, marketed, sold and/or otherwise distributed the instant pot pressure cooker;
  • Instant pot was marketed as a product which was safe to use and contained several safety features to prevent the pressure cooker from opening while the pressure was still inside the instant pot;
  • Despite these assurances, the pressure cooker was still able to open while under pressure, and
  • As a result, the customer or user sustained serious bodily injury, including burn injuries.
Many of the instant pot lawsuits involve claims of product liability which may include in adequate instruction, a manufacturing defect, or a defect in the design of the instant pot.

What types of defects may be found in an instant pot?

In any product liability claim, there are 3 main types of defects which can lead to liability of the manufacturer or distributor. A manufacturing defect, a design defect, or inadequate instruction or notice.

Manufacturing Defect - A manufacturing defect is typically caused by an error during the manufacturing process. This may include negligence of a factory worker failing to put is screw in the proper place, or accidentally using the wrong part, or storing the product improperly.

Design Defect - A design defect involves improper or inadequate design of a product which causes the product to be unsafe in one way or another. In the pressure cooker field, this may involve using a locking pin which is too short to adequately keep a pressure cooker from unlocking when a user tries to open the pressure cooker while it is still pressurized. It may also include the use of metal strike plate material which can bend when a user uses pressure to open the lid while the unit is still pressurized. It may also involve a situation where the lid does not adequately seal and can shoot off on its own while the pressure is building inside the pressure cooker without the customer ever touching the unit.

Inadequate instruction - Manufacturers have a duty to warn customers of known dangers, including dangers they are aware of from common misuse of the pressure cookers. This is one of the reasons why pressure cookers come with instruction manuals and also have screen printed lettering on top of the pressure cooker itself. Sometimes warnings change overtime, but the pressure cooker company does not go back and warn prior owners of these updates. Sometimes pressure cooker companies are aware of foreseeable misuse, but failed to give any adequate warning to the customer to prevent burn injuries from occurring.
